We represent businesses engaged in plant siting, providing advice on potential environmental liabilities and negotiating appropriate protections, warranties and indemnifications. We have considerable experience in negotiating sales or leases involving problem sites characterized by adverse environmental conditions.

We advise businesses about compliance with federal and state environmental laws covering such matters as hazardous waste, toxic substances, air and water quality, timber management and land use. We have counseled defendants in administrative enforcement actions arising out of alleged violations of those same laws, appearing in administrative hearings, civil trials and appeals. We also represent clients involved in state and federal superfund cleanups.

We regularly assist clients in preparing a wide variety of environmental permits. We provide advice to both businesses and governmental agencies on all facets of the National Environmental Policy Act (NEPA), including legal and policy guidance on the development of environmental impact statements as well as litigation concerning NEPA issues in the federal courts.
