Frank X. Curci Authors Chapter on Key Considerations in Technology Licensing

Frank X. Curci, a partner in Ater Wynne LLP’s business and intellectual property groups, provides his insight on key technology licensing issues in his recently published chapter entitled “Technology Licensing: Strategic Issues Every Licensor and Licensee Should Consider.” The work is part of the “Intellectual Property and Competitive Restrictions” volume of the “Advising Oregon Businesses” legal book series published by the Oregon State Bar.

Frank’s chapter, which draws on his many years of experience advising businesses regarding technology licensing and working with clients to develop proactive intellectual property strategies, guides readers through a range of considerations that impact the use and commercial value of their technology and intellectual property rights.  The chapter addresses critical technology licensing issues and intellectual property strategies that many of today’s high tech and bioscience companies, universities and research institutions are facing.

As noted in Frank’s published work, our technology-driven world is pushing technology companies, universities and research institutions to develop newer and more innovative technology. This drive for innovation increases the importance of technology licensing for many of these entities. For high tech and bioscience companies, the ability to license out their innovations for royalties or license in new technology from others is often a key business strategy. For many universities and research institutions, licensing out inventions developed in their labs is often a critical step in commercializing that technology.

Frank’s chapter is a useful guide for the key issues and negotiating points that these entities —whether as the licensor or licensee—need to consider before entering into technology licensing arrangements. His chapter provides interesting insight into the perspective of licensors versus licensees on many strategic intellectual property and technology issues.
